1. Acceptance of the terms
These general terms of use ("ToU") govern the use of the MotorTax mobile application (iOS and Android) as well as the motortax.ch website (collectively, the "Service").
By downloading, installing or using the Service, you accept these ToU without reservation. If you do not agree, do not use the Service.
You declare that you are at least 16 years old, or that you have the consent of a parent or legal guardian if you are younger.
2. Description of the Service
MotorTax is a vehicle tax calculator for Switzerland. The Service allows you to:
- Compare annual registration taxes across the 26 Swiss cantons for motorised vehicles (cars, motorcycles, boats).
- Save your vehicles in a personal area ("My Garage").
- Keep a history of the analyses performed.
The basic features of the Service are free. The PRO area (fleet management, real costs, reports) is offered as a paid subscription, described in section 2.1.
2.1 PRO area and subscription
The PRO area is offered as a monthly or yearly subscription purchased through the App Store (Apple) or Google Play (Google), depending on your device. The price is shown in the app before any purchase. The 14-day free trial is for new subscribers only; unless cancelled at least 24 hours before it ends, it continues as a paid subscription. The subscription renews automatically at the current price unless cancelled at least 24 hours before the end of the current period, in your Apple or Google account settings. Purchases are handled and billed by Apple or Google; refunds follow the App Store terms. Without a subscription, your vehicles and reports remain accessible, and the free version holds up to 5 vehicles per category.
3. Limitation of liability
The actual and final amount of the vehicle tax is set exclusively by the traffic department of the canton of registration. MotorTax cannot be held liable for:
- any discrepancy between the calculated amount and the amount billed by the cantonal administration.
- purchase, registration or relocation decisions made on the basis of the Service's results.
- subsequent changes to cantonal tax schedules not yet integrated into the catalogue.
- errors or omissions in vehicle technical data sheets.
The Service is provided "as is", without warranty of any kind, express or implied, in particular regarding uninterrupted availability or absence of errors.
Within the limits permitted by Swiss law, MotorTax disclaims all liability for indirect or immaterial damages, or damages resulting from a loss of use, data or profits related to the use of the Service.
4. Acceptable use
By using the Service, you undertake not to:
- use the Service for unlawful purposes or to infringe third-party rights.
- attempt to bypass security, authentication or rate-limiting measures.
- perform massive automated scraping of the catalogue or the results.
- commercially reuse the Service's data without prior written agreement.
- distribute viruses, malicious code or other harmful elements.
- impersonate another person.
5. Intellectual property
All elements composing the Service — source code, interfaces, texts, graphics, logo, vehicle catalogue database, calculations and formulas — are the exclusive property of Schneuwly Consulting or its licensors, and are protected by Swiss and international copyright law.
No licence or assignment is granted to the user, except for the personal and non-transferable right to use the Service in accordance with these ToU.
The vehicle brand names and logos mentioned in the catalogue remain the property of their respective holders and are used only for descriptive purposes.

6. Changes to the Service
We reserve the right to modify, suspend or discontinue all or part of the Service at any time, with or without notice, in particular for technical, legal or commercial reasons. We cannot be held liable to you or to any third party for such changes.
These ToU may be revised. The date of the latest update is indicated at the top of the page. By continuing to use the Service after the publication of a revised version, you accept the new terms.
Should the PRO area be discontinued on a lasting basis for reasons attributable to us, the subscribers concerned would be informed and could request a pro-rata refund from Apple or Google, in accordance with their rules.
7. Suspension and termination
You may stop using the Service at any time, without formality, by uninstalling the application. If you have created an account, you may request its deletion at contact@motortax.ch.
We reserve the right to suspend or terminate your access to the Service, without notice, in case of violation of these ToU or of manifestly abusive or unlawful use.
8. Personal data
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these ToU.
9. Applicable law and jurisdiction
These ToU are governed exclusively by Swiss law, to the exclusion of its conflict-of-laws rules and of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
In case of dispute, the parties shall endeavour to find an amicable solution. Failing that, the jurisdiction is the canton of Vaud, Switzerland, subject to the mandatory provisions of consumer law.
